The regathering of Parliament, on the 11th of November, was distinguished by two circumstances of very unequal interest. The Prince of Wales, having arrived at his majority, took his seat as Duke of Cornwall, as it was well known, intending to vote for a great measure which Fox was introducing regarding India. We shall now almost immediately enter on the narration of the[302] important events which had been transpiring in India during the American war. It is sufficient here to observe that these were of a nature to give the most serious concern and alarm to all well-wishers of the country, and of the unfortunate natives of that magnificent peninsula. Fox's measure for the reform and restraint of the East India Company was comprehended in two Bills, the first proposing to vest the affairs of the Company in the hands of sixteen directors, seven of them to be appointed by Parliament, and afterwards sanctioned by the Crown, and nine of them to be elected by the holders of stock. These were to remain in office four years; the seven Parliament nominees to be invested with the management of the territorial possessions and revenues of the Company; the nine additional to conduct the commercial affairs of the Company under the seven chief directors; and both classes of directors to be subject to removal at the option of the king, on an address for the purpose from either House of Parliament. The second Bill related principally to the powers to be vested in the Governor-General and Council, and their treatment of the natives.

The new year of 1815 was commenced by a heavy fire along the whole of this defence from thirty-six pieces of cannon, the immediate effect of which was to drive the Americans, in a terrible panic, from their guns, and walls composed of cotton bales and earth. Why an immediate advance was not made at this moment does not appear. It would probably have placed the whole of the American defences in the hands of the British troops, and driven the Americans into the city. TWO:Such was the state of affairs at home and abroad during the recess of 1829. The Government hoped that by the mollifying influence of time the rancour of the Tory party would be mitigated, and that by the proposal of useful measures the Whig leaders would be induced to give them their support, without being admitted to a partnership in power and the emoluments of office. But in both respects they miscalculated. The Duke met Parliament again on the 4th of February, 1830. It was obvious from the first that neither was Tory rancour appeased nor Whig support effectually secured. The Speech from the Throne, which was delivered by commission, was unusually curt and vague. It admitted the prevalence of general distress. It was true that the exports in the last year of British produce and manufacture exceeded those of any former year; but, notwithstanding this indication of an active commerce, both the agricultural and the manufacturing classes were suffering severely in "some parts" of the United Kingdom. There was no question about the existence of distress; the only difference was as to whether it was general or only partial. In the House of Lords the Government was attacked by Earl Stanhope, who moved an amendment to the Address. He asked in what part of the country was it that the Ministers did not find distress prevailing? He contended that the kingdom was in a state of universal distress, likely to be unequalled in its duration. All the great interestsagriculture, manufactures, trade, and commercehad never at one time, he said, been at so low an ebb. The Speech ascribed the distress to a bad harvest. But could a bad harvest make corn cheap? It was the excessive reduction of prices which was felt to be the great evil. If they cast their eyes around they would see the counties pouring on them spontaneously every kind of solicitation for relief; while in towns, stocks of every kind had sunk in value forty per cent. The depression, he contended, had been continuous and universal ever since the Bank Restriction Act passed, and especially since the suppression of small notes took effect in the beginning of the previous year. Such a universal and continued depression could be ascribed only to some cause pressing alike upon all branches of industry, and that cause was to be found in the enormous contraction of the currency, the Bank of England notes in circulation having been reduced from thirty to twenty millions, and the country bankers' notes in still greater proportion. The Duke of Wellington, in reply, denied that the Bank circulation was less than it had been during the war. In the former period it was sixty-four millions, including gold and silver as well as paper. In 1830 it was sixty-five millions. It was an unlimited circulation, he said, that the Opposition required; in other words, it was wished to give certain individuals, not the Crown, the power of coining in the shape of paper, and of producing a fictitious capital. Capital was always forthcoming[308] when it was wanted. He referred to the high rents paid for shops in towns, which were everywhere enlarged or improved, to "the elegant streets and villas which were springing up around the metropolis, and all our great towns, to show that the country was not falling, but improving." After the Duke had replied, the supporters of the amendment could not muster, on a division, a larger minority than nine. In the House of Commons the discussion was more spirited, and the division more ominous of the fate of the Ministry. The majority for Ministers was only fifty-three, the numbers being 158 to 105. In the minority were found ultra-Tories, such as Sir Edward Knatchbull, who had proposed an amendment lamenting the general distress, Mr. Bankes, Mr. Sadler, and General Gascoigne, who went into the same lobby with Sir Francis Burdett, Lord John Russell, Mr. Brougham, Mr. Hume, and Lord Althorp, representing the Whigs and Radicals; while Lord Palmerston, Mr. Huskisson, Mr. Charles Grant, and Sir Stratford Canning represented the Canning party. TWO:The campaign in Flanders opened in April. The British faithfully furnished their stipulated number of men (twenty-eight thousand), but both Austria and Holland had most disgracefully failed. Holland was to send fifty thousand into the field, and keep the other ten thousand in her garrisons; but she had sent less than half that number, and Austria only eight squadrons. The French had a fine army of seventy-five thousand men under the able general, Marshal Saxe; and the King of France and the Dauphin had come to witness the conflict, which gave a wonderful degree of spirit to their troops. On the part of the Allies, the Duke of Cumberland was chief in command, but, from his youth, he was not able to set himself free from the assumptions of the Austrian general, old Marshal K?nigsegg, and the Dutch general, the Prince of Waldeck. As it was, to march against the French before Tournay was to rush into a certain contest with the whole French army of nearly eighty thousand men, whilst the Allies could have only about fifty thousand. Saxe made the ablest arrangements for the coming fight. He left fifteen thousand infantry to blockade Tournay, drew up his army in a very strong position a few miles in advance, and strengthened it by various works.
THREE:The excitement was kept up during the summer and autumn by meetings held in various places, and the arrest of persons taking a prominent part in the proceedings. On the 4th of August there was an evening meeting at Manchester held in Stephenson's Square, when about 5,000 persons attended. The object was to determine whether "the sacred month" should commence on the 12th of August or not. Mr. Butterworth, who moved the first resolution, said he considered that the Chartists of 1839 were the Whigs of 1832, and the Whigs of 1839 were the Tories of 1832. The Whigs were more violent then than the Chartists now, and yet the Whigs were the very men to punish the Chartists. During the meeting persons[458] in the crowd continued to discharge firearms. There was, however, no disturbance of the public peace.

THREE:The safety of the prisoners diffused universal joy throughout the camps of the two generals; but there was one thing necessary, in their opinion, in which the Government concurred, in order to give the crowning proof of our complete triumph, and to restore the unquestionable supremacy of our power, and compel the respect and fidelity of the neighbouring provinces. This was the signal punishment of Cabul for the atrocities that had been perpetrated there. The hostile chiefs were now as eager to conciliate, as submissive in their tone as they had been cruel and arrogant. Even Akbar Khan professed the greatest friendship for the British, and repudiated the acts that had been done in his name, at the same time restoring to his friends Captain Bygrave, the last prisoner he had in his possession. The Afghans had a maiden fortress in the town of Istalif, which is built upon two ridges of the spur of Hindoo Koosh, which forms the western boundary of the beautiful valley of Kohistan. There, in its fortified streets and squares, as in a safe asylum, they had collected their treasures and their women. The sagacious Havelock suggested that the capture of this place, believed to be impregnable, would be a great stroke of policy. General M'Caskill, therefore, made a rapid march upon it, and after a desperate struggle, in which Havelock greatly distinguished himself, the place was stormed in gallant style, the Afghans in every direction giving way before our attacking columns.

THREE:The arbitrary crushing of the freedom of the Tyrol, and the handing of it over to the Bavarians as a gift, was not the only oppression of this period of Napoleon's career, which the Germans call his supremacy. He seemed to have put down all opposition on the Continent, except in Spain, and he dictated to all nations according to the arrogance of his will. His general in Poland, Poniatowski, himself a Pole, was employed to crush his countrymen. Poniatowski fell on the Austrians with forty thousand men, and made himself master of Warsaw, whilst the Archduke Ferdinand was besieging Thorn. He then advanced against the archduke, beat him in two battles fought in April and May, and eventually drove the Austrians out of the Grand Duchy of Warsaw. Buonaparte then divided Galicia, giving one portion to the Emperor of Russia, and adding the other to the Grand Duchy of Warsaw, which was restored to the King of Saxony. Thus the Poles saw an end of all the high hopes with which Buonaparte had artfully succeeded in inspiring them, in order to induce them to[594] fight his battles for the subjugation of other peoples.[94]

THREE:[See larger version]All this time, too, the brave Tyrolese were in open revolt, so that the success of Austria would have instantly produced a universal rising of the country. But for six weeks the Austrians continued to allow Napoleon to keep open his communication with Vienna, whence he procured every material for building, not one bridge, but three; timber, cordage, iron, and forty engines to drive the piles, were procured from its ample magazines. Besides building the bridges, Buonaparte had quickly fortified the island, and placed batteries so as to prevent any successful attack upon him, whilst he was now furnished with the means of issuing from the island almost at pleasure. Since their being cooped up on Lobau, the French had received numerous reinforcements; and though the Archduke John was marching to join the Archduke Charles, Eugene Beauharnais was close at his heels, continually harassing him and compelling him to fight. On the frontiers of Hungary, the town of Raab ought to have enabled John to resist and retard Beauharnais, and have allowed the Archduke Regnier, who was organising another army in Hungary, to come up; but Raab only stood out eight days, and John was obliged to cross the Danube at Pressburg, to endeavour to advance and make a junction with the Archduke Charles. But Eugene Beauharnais managed to join Buonaparte still earlier, and the Emperor did not then allow John to unite with Charles; for, on the night of the 5th of July, he began to fire on the Austrians, on the left bank of the Danube, from gunboats; and whilst they were replying to this, he quietly put his forces across the river. At daylight the next morning the Archduke Charles was astonished to find the French army on the open land; they had turned his whole position, had taken the villages of Esslingen and Enzersdorf, and were already assailing him in flank and rear. The archduke retired upon Wagram, which was lost and taken several times during the day. Buonaparte attempted to break the centre of the Austrian line by a concentrated fire of grape-shot, but the Austrians replied vigorously with their artillery. The French were held in check, if not repulsed. The Saxons and other German troops displayed a disposition to break, and go over to the Austrians. Buonaparte spoke sharply to Bernadotte of the conduct of the Saxons, and the marshal replied that they had no longer such soldiers as they brought from the camp of Boulogne. When night closed the French were in confusion, and, in reality, worsted. The next morning, the 6th of July, the archduke renewed the attack on all the French lines, but is said to have left his centre too weak. Buonaparte again endeavoured to break it, but failed. Bernadotte, Massena, and Davoust were all in turn driven from their positions. Buonaparte, in a state of desperation, cried, "The Austrian centre must be battered with artillery like a fortress." He ordered Davoust to make a desperate charge on the left wing, and called on Drouet, the general of his artillery, to bring up all the artillery of the Guard, and support Davoust. Davoust directed the whole of his force on the left wing, which was broken, and then Buonaparte, forming a dense and deep column of all his best troops, old and new Guards, and his celebrated[591] Grenadiers cheval, under Macdonald and Beauharnais, drove against the centre with a fury that shattered it, and the battle was decided. But at what a price! The Austrians had twenty-six or twenty-seven thousand killed and wounded, and the French upwards of thirty thousand. Buonaparte lost three generals, and had twenty-one wounded. The Austrians had thirteen generals killed or wounded; but they had taken many more prisoners than they had lost. Whilst the battle was raging, the Archduke John was approaching from Pressburg; but Austrian slowness, or, as it is said, conflicting orders from his brother and the Aulic Council, did not permit him to come up in time, or he would assuredly have turned the day.

TWO:The supplies and the Mutiny Bill were now passed without much difficulty, but Ministers did not venture to introduce an Appropriation Bill. On the 23rd, Lord North, stating that the dissolution of Parliament was confidently asserted out of doors, declared that such a dissolution, without passing an Appropriation Bill, would be an unparalleled insult to the House. He expressed his astonishment that the Minister did not condescend to utter a syllable on the subject of the proposed change. Pitt, now confident of his position, replied that gentlemen might ask as many questions as they pleased; that he had adopted a course which was advantageous to the country, and did not feel bound to enter then into any explanations. All mystery, however, was cleared up the next day, for the king went down to the House of Lords and prorogued Parliament, announcing that he felt it his duty to the Constitution and the country to convoke a new Parliament. Accordingly, on the following day, the 25th of March, he dissolved Parliament by proclamation.Pitt had returned to office in anything but promising circumstances. Britain was at war with a great nation, and as yet the coalition which he was laboriously building up was far from being complete. Pitt's health was failing: his energies were prematurely worn out by the gigantic task that was forced upon him; his end was fast approaching, and his majority was shrunk and attenuated to an alarming degree. The Fox and Grenville opposition held together firmly, and Addington had carried a strong party along with him on retiring. Pitt felt his situation keenly and the king was sensibly alarmed at it. He attempted to conciliate Grenville, but, as Fox could not be accepted too, that failed. He then turned to Addington, and as the king was favourably disposed to his old minister, he warmly recommended this coalition. It was effected, and Addington was made a peerViscount Sidmouth, of Sidmouth. This was one of those rapid political promotions of George III.'s reign in which politics were made to ennoble men of no particular mark or abilities; and certainly the son of Pitt's father's doctor had never shown those splendid talents or rendered those brilliant services which justified such an elevation. But, as Pitt would take the lead in the Commons, it was, no doubt, felt more convenient that one who had lately been Prime Minister should not serve under the present Prime Minister, but should represent the Cabinet in the Upper House. There were some other changes at the same time. The Duke of Portland, who was growing old and infirm, retired from the post of President of the Council, which Sidmouth took up. Lord Harrowby, a warm friend of Pitt, retired, in consequence of continued illness, from the Foreign Department, and Lord Mulgrave took it, the Earl of Buckinghamshire succeeding to Lord Mulgrave's post as Chancellor of the Duchy of Lancaster.

  • THREE:The storm grew every day more violent, and on the 11th of February, 1741, Sandys, who had acquired the name of "the Motion Maker," announced that he intended to make a motion for a direct condemnation of the Minister, and for his removal from office. On the following Friday Sandys made his threatened motion of condemnation. The surprise of the debate occurred when Shippen"the thorough Shippen," as he was calledsaid that he would not join in the ruin of the assailed Minister. He declared that he never followed any dictates of self-interest, and cared little who was in or out, unless he could see a prospect of different measures; but that he regarded this movement only as the attempt to turn out one Administration in order to bring another in. He would therefore have no concern in it, and with that he withdrew, followed by thirty-four of his party. On the 30th of January the rebel army retreated from Perth, the Highland soldiers, some in sullen silence, others in loud curses, expressing their anger and mortification at this proceeding. The inhabitants looked on in terror, and bade adieu to the troops in tears, expecting only a heavy visitation for having so long harboured them. TWO:The corruptions connected with the Duke of York and his mistress were but a small fragment of the wide and universal system which was existing. The exposures, however, made by this inquiry induced the Chancellor of the Exchequer to bring in a Bill to prevent such abuses. He referred to the sale of commissions which had been brought to light, and which had been carried on by means of improper influence over a man in high office. His Bill, therefore, went to make it penal to demand money for the appointment to office, or to issue advertisements to that effect. The Bill was passed.During the summer a French squadron stretched away across the Atlantic with six sail of the line, and finding our Newfoundland coasts almost wholly unprotected, destroyed and plundered the fishermen's huts and fishing stages, as well as their vessels, and then, returning, picked up a considerable number of our merchantmen at sea, and was lucky enough to make a retreat, by favour of a fog, through our watching squadrons, into Brest. After this clever exploit, they joined the great Brest fleet, which sailed for Ireland on the 15th of December. This consisted of no fewer than forty-three sail, seventeen of them of the line, four frigates, six corvettes and brigs, with six transports. On board the transports were twenty-five thousand men, who had been well tried in the war of La Vende, and abundance of arms and ammunition, as well as extra arms to put into the hands of the disaffected Irish, for to Ireland the armament was bound. General Hoche, who had terminated the Vendan war, was appointed to terminate all the woes of Ireland, and convert that sacred island into another French paradise. Besides Hoche, Generals Grouchy, Hombert, and Bruix were attached to the expedition. The fleet sailed out and anchored in Camaret Bay, but no British fleet was visible to intercept them. But no sooner did the armament put out to sea again the next day, than it was assailed by a tempest and the ships were driven different ways. One of them was forced immediately on the Grand Stenet rock, and wreckedout of one thousand four hundred souls on board only sixty were rescued. Seven ships of the line, and ten of the vessels commanded by Rear-Admiral Bouvet, managed to reach Bantry Bay on the 24th of December, but there the storms continued to batter them. There being no sign of an insurrection, and no other part of the fleet appearing, they sailed back and reached Brest on the 1st of January, 1797. When they were gone, another portion of the fleet arrived in Bantry Bay, but only to be tossed and driven about without rest, to lose several of the ships, and to put back again. As for Hoche, he never saw Ireland; the greater part of the fleet being driven about and swamped in the Channel. Of the forty-three sail, only thirty-one returned, and thousands of the soldiers were drowned in the foundering transports. Sir Edward Pellew, in the Indefatigable, of forty-four guns, and Captain Reynolds, in the Amazon, of thirty-six guns, fell in with the Droits de l'Homme, of seventy-four guns, and after a severe fight close in Audierne Bay, south of Ushant, left her a wreck aground, where, of the one thousand eight hundred men aboard, scarcely more than three hundred were saved, notwithstanding the greatest exertions of the British seamen to rescue them.
FORE:For some time a monster petition to the House of Commons was being signed by the Chartists in all the towns throughout the United Kingdom, and the signatures were said to have amounted to five millions. It was to be presented on the 10th of April. Two hundred thousand men were to assemble on Kennington Common, and thence they were to march to Westminster, to back up their petition. Possibly they might force their way into the House of Commons, overpower the members, and put Mr. Feargus O'Connor in the Speaker's chair. Why might they not in this way effect a great revolution, like that which the working classes of Paris had just accomplished? If the French National Guard, and even the troops of the line, fraternised with the people, why should not the British army do likewise? Such anticipations would not have been unreasonable if Parliamentary and Municipal Reform had been up to this time resisted; if William IV. had been still upon the throne; if a Guizot had been Prime Minister, and a York or a Cumberland at the Horse Guards. The Chartists, when they laid their revolutionary plans, must have forgotten the loyalty of the English people, and the popularity of the young Queen. They could not have reflected that the Duke of Wellington had the command of the army; that he had a horror of riots; and that there was no man who knew better how to deal with them. Besides, every one in power must have profited by the unpreparedness of the French authorities, and the fatal consequences of leaving the army without orders and guidance. All who were charged with the preservation of the peace in England were fully awake to the danger, and early on the alert to meet the emergency. On the 6th of April a notice was issued by the Police Commissioners, warning the Chartists that the assemblage of large numbers of people, accompanied with circumstances tending to excite terror and alarm in the minds of her Majesty's subjects, was criminal; and that, according to an Act of the 13th of Charles II., no more than ten persons could approach the Sovereign, or either House of Parliament, on pretence of delivering petitions, complaints, or remonstrances; and that whereas information had been received that persons had been advised to procure arms and weapons to[556] carry in procession from Kennington Common to Westminster, and whereas such proposed procession was calculated to excite terror in the minds of her Majesty's subjects, all persons were strictly enjoined not to attend the meeting in question, or take part in the procession; and all well-disposed persons were called upon and required to aid in the enforcement of the law, and the suppression of any attempt at disturbance.

FORE:A Privy Council was held at Dublin Castle, at which it was determined to offer rewards for the arrest of the principal conspirators500 for William Smith O'Brien, and 300 each for Meagher, Dillon, and O'Doherty. The offence charged was, having taken up arms against her Majesty. The rewards offered soon brought matters to a crisis. As soon as the proclamations were posted up, Sub-Inspector Trant proceeded from Callan, in the county Kilkenny, with a body of between fifty and sixty of the constabulary, in the hope of capturing some of the proclaimed rebels. Arrived on Boulagh Common, near Ballingarry, on the borders of Tipperary and Kilkenny, they took possession of a slated farmhouse, belonging to a widow named Cormack. This house they hastily fortified, by piling tables, beds, and other articles against the doors and windows. The insurrection actually commenced at a place called Mullinahone, where, at the ringing of the chapel bell, large numbers of the peasantry assembled in arms, and hailed Smith O'Brien as their general. He was armed with a short pike and several pistols, which he had fastened to a belt. On the 26th of July he went to the police barrack, where there were but six men, and endeavoured to persuade them to join him, promising better pay and promotion under the republic, and telling them that they would resist at their peril. They refused. He then demanded their arms, but they answered that they would die rather than surrender them. He gave them an hour to consider, but departed without carrying his threat into execution. On the 29th Mr. Smith O'Brien appeared on Boulagh Common with increased forces, who surrounded the house in which the constabulary were shut up. He went into the cabbage garden to speak to the police at an open window. He addressed one of the men, and earnestly pressed them to surrender and give up their arms. The constable said he would call Mr. Trant. That gentleman immediately hastened to the spot; but the rebel chief had taken his departure. Apprehending an attack, Mr. Trant immediately ordered his men to fire, when a battle commenced, which speedily terminated in the defeat of the rebels, of whom two were killed and several wounded. Two shots were aimed at Smith O'Brien without effect; but one of them hit a rebel who was standing by his side brandishing a pike. He was killed on the spot. Another party of police under the command of Mr. Cox, and accompanied by Mr. French, the stipendiary magistrate, came up at the instant, and fired on the rebels, after which they fled in the greatest disorder. Eighteen were killed, and a large number wounded. The police suffered no loss whatever. A large detachment of the 83rd Regiment and about 150 of the constabulary, with Inspector Blake, hastened to the defence of the besieged party; but when they arrived the danger was over, and the police returned to Callan. That evening twenty signal fires blazed on the mountain of Slieve-na-mon. Next day, being Sunday, the military did not attend public worship, and were everywhere kept on the alert. The greatest excitement appeared amongst the peasantry at the Roman Catholic chapels, who were in hourly expectation of being called upon to act, the most anxious solicitude being painted upon the countenances of the women. There is no doubt, from the temper of the population, that had the priests given the word, there would have been a general rising. But they almost universally condemned the conduct of the leaders as insane, and as certain to involve them and all who joined them in destruction. In the meantime, General[569] Macdonald, at the head of his flying column, consisting of 1,700 men, pursued the insurgents, while troops and artillery were poured into Clonmel, Kilkenny, and Thurles. Near the latter place General Macdonald encamped on the domain of Turtulla, the seat of Mr. Maher, M.P. The butchers of Thurles refused to supply the men with meat, and consequently provisions had to be brought from the commissariat stores at Limerick, and large quantities of biscuits from Dublin, the people having broken into the house of the baker who supplied them with bread at Thurles and destroyed his furniture.[See larger version]

FORE:The feeling of humanity that gained ground among the masses powerfully affected the middle classes. The consequence was that the state of public feeling produced by the practical inculcation of Christianity and the diffusion of knowledge compelled our legislature to change its system, despite the obstinate resistance of Lords Eldon and Ellenborough, hardened by a long official familiarity with the destructive operation of legal cruelty. How fearful the amount of that destruction was we may infer from the calculation of Mr. Redgrave, of the Home Office, who stated that had the offences tried in 1841 been tried under the laws of 1831, the eighty capital sentences would have been increased to 2,172. Mr. Redgrave gave the following succinct history of the mitigation of the criminal code during the reigns of George IV. and William IV., in a series of enactments which were extorted from a reluctant Legislature by society, humanised through the education of the masses:In 1826, 1827, and 1828 Sir Robert Peel carried several very important Bills for the consolidation and amendment of the criminal laws, but these Bills did not abolish capital punishments. That statesman, indeed, made it a matter of boast that he did not constitute any new capital felonies, and pointed out an instance in which he had abated the capital punishment by increasing from 40s. to 5, the sum of which the theft in a dwelling-house constituted a capital offence, and by widening the technical description of a dwelling. In 1830 Sir Robert Peel brought in his Forgery Bill, and petitions were poured into the House from all quarters against the re-enactment of the severe penalties for this offence. Sir James Mackintosh again took up the subject, and moved that the capital punishment be struck out from the Bill. He was unsuccessful; but in the last stage of the measure Mr. Spring-Rice was enabled to defeat the Ministry by a majority of 151 to 138, and to remove the sentence of death from the Bill. It was, however, restored by the Lords, and the Bill, as altered, was suffered to pass the House of Commons at the end of the Session. In 1832 two most important Bills for abolishing capital punishments were passed. Mr. Ewart, assisted by the Government, was able to carry a Bill abolishing the punishment of death in cases of horse, sheep, and cattle stealing, and larceny in a dwelling-house. He was opposed by Sir Robert Peel, and an amendment was made in the Lords, subjecting these offences to the fixed penalty of transportation for life. At the same time, Ministers brought in a Bill for abolishing capital punishment in cases of forgery. The Bill was introduced into the Commons by the Attorney-General, and into the House of Lords by the Lord Chancellor. It passed into law, but an amendment was made in the House of Lords, under protest of the Lord Chancellor, exempting the forgery of wills and powers of attorney to transfer stock, which offences were left capital. In 1833 Mr. Leonard carried his Bill for abolishing capital punishment for housebreaking, executions for which offence were continued down to 1830. In 1834 Mr. Ewart carried a Bill for abolishing capital punishment for returning from transportation, and in the following year for sacrilege and letter-stealing. This was the state of the criminal law when Lord John Russell brought in Bills for its mitigation, founded on the report of a committee which Government had appointed. The little progress which Sir S. Romilly and Sir J. Mackintosh had made in opposition to the Governments of their day will be seen by the foregoing sketch, as well as the extensive and salutary changes which followed. Lord John Russell's Bills effected an extensive abolition of the sentence of death, and a mitigation of the secondary punishments. He was enabled to abolish capital punishments in all cases but murder and attempts to murder where dangerous bodily injuries were effected; burglary and robbery when attended with violence or wounds; arson of dwelling-houses where life was endangered; and six other offences of[427] very rare occurrence. The number of capital convictions in 1829 was 1,385; and in 1834, three years after the extensive abolition of capital punishments, the number was reduced to 480.[See larger version]

FORE:It was no wonder that Spain, feeling the serious effects of this state of things, should resist it; and when she did so, and exerted an unusual degree of vigilance, then the most terrible outcries were raised, and wonderful stories were circulated of Spanish cruelties to our people beyond the Atlantic. At this time the Opposition got hold of one of these, and made the House of Commons and the nation resound with it. It was, that one Captain Robert Jenkins, who had been master of a sloop trading from Jamaica, had been boarded and searched by a Coastguard, and treated in a most barbarous manner, though they could detect no proof of smuggling in his vessel. He said that the Spanish captain had cut off one of his ears, bidding him carry it to his king, and tell his Majesty that if he were present he would treat him in the same manner. This story was now seven years old, but it was not the less warmly received on that account. It excited the utmost horror, and Jenkins was ordered to appear at the bar of the House of Commons on the 16th of March, to give an account of the outrage himself; and it would appear that both he and other witnesses were examined the same day. Jenkins carried his ear about with him wrapped in cotton, to show to those to whom he related the fact, and the indignation was intense. He was asked by a member how he felt when he found himself in the hands of such barbarians, and he replied, "I recommended my soul to God, and my cause to my country." The worthy skipper had probably been crammed with this dramatic sentiment by some of his clever Parliamentary introducers; but its effect was all the same as if it had been a genuine and involuntary expression of his own mind. Researches made at the Admiralty in 1889 proved that he really had lost an ear.

Wolfe raised batteries at Point Levi and on the island, and bombarded the town, but he could not draw the wary Montcalm from his strong position. In his front lay the river and some unapproachable sandbanks, behind and around him rocks and dense woods inaccessible. Once only he made a rush across the river, and endeavoured, with a detachment of one thousand six hundred men, to gain the batteries on Point Levi; but his troops soon saw the attempt to be hopeless, and retired. No measures were neglected by Wolfe, on his part, to draw Montcalm from his position. He marched along the banks of the Montmorency opposite to him, and made feints as if he would cross it somewhere above him, but to no purposeMontcalm knew his advantage. Wolfe wrote home, that if Montcalm had but shut himself up in Quebec, he could have taken the town very easily, but he could not readily force him from his admirable position. Growing at length impatient, he determined to attack him where he was, and he dispatched Admiral Holmes up the river with a number of transports, as though he contemplated something in that quarter. He then landed, on the 31st of July, a body of troops near the mouth of the Montmorency, which there falls three hundred feet into the St. Lawrence. He had discovered a ford at some distance up the river, and dispatched Brigadier Townshend to cross there and attack Montcalm in flank, whilst he himself, by means of the ships and their boats, gained the beach and attacked in front. The Centurion man-of-war was placed to engage a battery which swept the place of landing, and then the troops were conveyed in boats, which drew little water, towards the shore. Some of these, however, got entangled amongst rocks, and created a delay in getting them off. By this time the French were hurrying down towards the landing-place with their artillery, and began to fire murderously from the banks above upon them. Wolfe, seeing that Townshend would cross the ford before they were ready to co-operate, sent an officer to recall him. At this time, the Grenadiers having reached the beach, rushed forward upon the entrenchments before the rest of the troops could be got out of the boats to support them. They were met by such a destructive fire that they were compelled to fall back with much slaughter. By this time night was setting in, attended by a storm, the roaring of which, mingling with the roar of the mighty St. Lawrence as the tide fell, seemed to warn them to recover their camp. The word was given to re-cross the river, and they made good their retreat without the French attempting to pursue them, though the Indians lurked in the rear to scalp such of the dead and such of the wounded as could not be brought off.[See larger version]On the 3rd of February the Commons attended to hear the commission read at the bar of the Lords, which was done by Earl Bathurst, in the absence of Thurlow. On returning to their House now as an authorised Parliament, the Commons read the Bill for the first time without a division, but on the second reading, on the 6th of February, Burke attacked it with unabated ferocity. He wanted to know how they were to determine when the king was sane again. Who was to inform them of it? Who was to certify it? He asserted the utter impossibility of adducing proof whether a person who had been insane were perfectly recovered or not. If this doctrine had been established, the regency must have become permanent. But this mode of reasoning was too metaphysical for the House of Commons; the debate passed on, and the Bill was committed. The clause providing against the non-residence of the prince, and against his marrying a papist, again brought up Mr. Rolle. He said that he had given his assent to the appointment of the prince regent on the assurance of his friends, that he was not married to a certain lady, either in law or in fact; but that he had since read a famous pamphlet, which affirmed that the facts were in opposition to those avowals. This was a brochure of Horne Tooke's, in the shape of a letter to a friend, in which he declared his positive knowledge of the prince's marriage with "the late Mrs. Fitzherbert," who, he contended, in spite of the Marriage Act, was his lawful wife. Rolle was answered by Lord North, who declared that the object of the pamphleteer was simply to make mischief by throwing out assertions that he never meant to prove, and Welbore Ellis called for the reading of the Royal Marriage Act, and showed that no royal marriage could be valid without the king's consent, and that, therefore, whatever was the case, all those objections were a mere waste of words. Rolle did not press the question to a division. The other clauses of the Bill raised much debate, but were all passed, and on the 10th of February the council was appointed to assist the queen in her charge, and Pitt named as members of it[347] the four principal officers of the household, the Lord Chamberlain, the Lord Steward, the Master of the Horse, and the Groom of the Stole, with the addition of the Archbishop of Canterbury, Lord Chancellor Thurlow, the Archbishop of York, and Lord Kenyon. The names of the Prince of Wales, the Duke of York, several of the other princes, the Lord Mayor of London, and the Speaker of the House of Commons, were all strongly urged upon Parliament as persons who ought to be members of this council, but they were, to a man, rejected by a majority of about fifty.[453]The aggressive policy of the Holy Alliance, and the French invasion of Spain, despite England's remonstrances, provoked Mr. Canning to hasten the recognition of the revolted colonies in South America. It was in defending this policy that he uttered the memorable sentence so often quoted as a specimen of the sublime:"Contemplating Spain such as our ancestors had known her, I resolved that if France had Spain, it should not be Spain with the Indies. I called the New World into existence to redress the balance of the Old."There was one object, however, to be gained which was deeply interesting to every true Briton in India as well as to the public at home, without which no victories however glorious, and no infliction of punishment however terrible, upon the enemy, would have been considered satisfactorynamely, the deliverance of the captives that were still held as hostages by Akbar Khan. On this subject the two generals, Pollock and Nott, held a consultation. Nott declared that the Government had thrown the prisoners overboard, and protested against taking any measures for their recovery. But Pollock was determined that the effort should be made, and took upon himself the responsibility of telling Nott to ignore his orders. Ellenborough, half-persuaded, sanctioned Pollock's remaining at Jelalabad until October, but commanded Nott to retire either by Quetta or Cabul. Nott and Pollock, however, disregarded these absurd orders, and the advance was continued. The duty of rescuing the prisoners was undertaken by Sale, whose own heroic wife was among them. He started in pursuit, taking with him a brigade from the army at Jelalabad. The captives had been hurried on towards the inhospitable regions of the Indian Caucasus, not suffered to sleep at night, and were stared at as objects of curiosity by the inhabitants of the villages through which they passed. They reached their destination, Maimene, on the 3rd of September, and there, in a short time, before Sale's brigade arrived, they had providentially effected their own ransom. The commander of their escort was Saleh Mahomed, a soldier of fortune, who had been at one time a soubahdar in Captain Hopkins's regiment of infantry, and had deserted with his men to Dost Mahomed. Between this man and Captain Johnson an intimacy sprang up, which the latter turned to account by throwing out hints that Saleh Mahomed would be amply rewarded, if, instead of carrying off his prisoners, he would conduct them in safety to the British camp. Days passed away without anything being done, till after their arrival at Maimene, when, on the 11th of September, Saleh Mahomed sent for Johnson, Pottinger, and Lawrence, and in a private room which had been appropriated to Lady Sale, he produced a letter which he had just received from Akbar Khan, directing him to convey the prisoners to a more distant prison-house. This seemed to be a sentence of hopeless captivity, but the officers' minds were soon relieved by another piece of intelligencenamely, a message from General Pollock that if Saleh Mahomed released the prisoners he should receive a present of 20,000 rupees, and a life pension of 1,000 rupees a month. Saleh said to them, "I know nothing of General Pollock, but if you three gentlemen will swear by your Saviour to make good to me what Synd Moortega Shah states that he is authorised to offer, I will deliver you over to your own people." The offer was gladly accepted; and an agreement was drawn up, in pursuance of which Saleh Mahomed and his European allies proclaimed their revolt to the people of Maimene and the surrounding country. They deposed the governor of the place, and appointed a more friendly chief in his stead. They supplied themselves with funds by seizing upon the property of a party of merchants who were passing that way. Major Pottinger assumed the functions of government, and issued proclamations, and called upon the chiefs to come in and make their salaam. But they might come for a different purpose, and hence they began to fortify themselves, and prepare for a very vigorous defence. While thus employed, a horseman was seen rapidly approaching from the Cabul side of the valley, who proved to be the bearer of glad tidings. The Jugduluk Pass had been forced; Akbar Khan had been defeated by General Pollock at Tizeen, and had fled, no one knew whither. This was delightful news indeed. The power of the oppressor was now broken, and the captives were free. Early next morning they started for Cabul, sleeping the first night upon stony beds under the clear moonlight; they were awakened by the arrival of a friendly[503] chief, who brought a letter from Sir Richmond Shakespear, stating that he was on his way to Maimene with a party of horse. On the 17th of September Shakespear, with his cavalry, came up. Pushing on again, they were met by a large body of British cavalry and infantry, under the command of Sir Robert Sale. "In a little time the happy veteran had embraced his wife and daughter; and the men of the 13th had offered their delighted congratulations to the loved ones of their old commander. A royal salute was fired. The prisoners were safe in Sale's camp. The good Providence that had so long watched over the prisoners and the captives now crowned its mercies by delivering them into the hands of their friends. Dressed as they were in Afghan costume, their faces bronzed by much exposure, and rugged with beards and moustachios of many months' growth, it was not easy to recognise the liberated officers, who now came forward to receive the congratulations of their friends."
